ADVERTISEMENT FOR BIDS

Sealed proposals will be received by the City of Fairhope, at Fairhope Public Utilities, 555 South Section Street, Fairhope, Alabama 36532; on October 24, 2023 at 10:00 A.M. at which time and place they will be publicly opened and read for:

CITY OF FAIRHOPE WORKING WATERFRONT AND GREENSPACE PROJECT

The Work of the project includes, but is not limited to, the restoration and new construction of the Fairhope Municipal Pier parking lot, park, waterfront, and pier. The parking lot will be renovated using approximately 900 tons of asphalt, 5,800 SY of brick pavers, and 3,000 LF of concrete curb. The park will be renovated with new landscaping and irrigation, approximately 3,900 SY of concrete sidewalk, a new restroom building, and associated water and sewer. The waterfront will be renovated with approximately 8,900 SF (face) of modular block seawall. The fountain will be renovated with a new pool and restoration of the existing centerpiece. The pier will be renovated with new handrail and lighting, and the restrooms refurbished. Stairs at the bluff will be replaced with new stairs. A new funicular (lift) will be installed at the bluff coordination and supervision of the entire project, and all related work, as indicated in the Bid and Contract Documents.

Four hundred thirty-five (435) calendar days are allowed for the construction of the project.

A cashier’s check or bid bond payable to THE CITY OF FAIRHOPE in an amount not less than five (5%) percent of the amount of the bid, but in no event more than $10,000, must accompany the bidder’s proposal. Performance and statutory Labor and material Payment Bonds, insurance in compliance with requirements, and verification of E-Verify enrollment will be required at the signing of the Contract.

The Issuing Office for the Bidding Documents is Goodwyn Mills Cawood, 2039 Main Street, Daphne, AL 36526, Attn: Barbara Garner, (251) 380-8732, Barbara.Garner@gmcnetwork.com. Prospective Bidders may examine the Bidding Documents at the Issuing Office Monday through Friday, 8:00 a.m. – 5:00 p.m. and may obtain copies of the Bidding Documents from the Issuing Office as described below.

General Contractors may procure plans and specifications from the Engineer upon payment of a deposit of twenty dollars ($20.00) for a one-time administrative fee for digital/file sharing access or one hundred dollars ($100.00) (printed) per set. Contractors are encouraged to use the digital plans. This deposit is non-refundable.

Checks shall be made payable to “Goodwyn Mills Cawood”. No bid documents will distributed later than 24 hours prior to the scheduled opening of bids. Partial sets of Bidding Documents will not be available from the Issuing Office. Neither Owner nor Engineer will be responsible for full or partial sets of Bidding Documents, including Addenda if any, obtained from sources other than the Issuing Office. All bidders bidding in amounts exceeding that established by the State Licensing Board for General Contractors must be licensed under the Provision of Title 34, Chapter 8, Code of Alabama, 1975, as amended, and must show such evidence of license before bidding or bid will not be received or considered by Architect or Owner. The bidder shall show such evidence by clearly displaying his or her current license number on the outside of the sealed envelope in which the proposal is delivered; Bidder must also include his or her current license number on the Proposal Form. No bid may be withdrawn after the scheduled closing time for receipt of bids for a period of one hundred (100) days.

A MANDATORY PRE-BID CONFERENCE will be held at the City of Fairhope, Public Work Conference Room (555 S. South Section Street) on October 10, 2023, at 10:00 A.M., for the purpose of reviewing the project and

answering Bidder’s questions. Attendance at the Pre-Bid Conference is mandatory for all General Contractor Bidders and Subcontractors intending to submit a Proposal.

Any contract awarded under this Invitation for Bids may be paid for in whole or in part with grant funding from the United States Department of the Treasury (“Treasury”) and the Alabama Department of Conservation and Natural Resources (“ADCNR”) under the Resources and Ecosystems Sustainability, Tourist Opportunities, and Revived Economies of the Gulf Coast States Act of 2012 (RESTORE Act). Any contract resulting from this solicitation will be subject to the terms and conditions of the funding award, the RESTORE Act Financial Assistance Standard Terms and Conditions and Program-Specific Terms and Conditions, the Standard Sub-Award Terms and Conditions, the RESTORE Act, 33 U. S. C. 1321(t), Treasury Regulations 31 C. F. R. § 34 et seq., including 31 C. F. R. §§ 34, Subpart D, all applicable terms and conditions in 2 C. F. R. Part 200 (including Appendix II to Part 200), and all other OMB circulars, executive orders or other federal laws or regulations, as applicable. Notwithstanding the above, neither ADCNR nor Treasury, or any of their agents, representatives, or employees, is or will be a party to this Invitation for Bids or any resulting contract. Further, any contractor awarded a contract under this Invitation for Bids shall not be deemed to be an agent, representative, employee or servant of ADCNR or Treasury.

Minority and women’s business enterprises are solicited to bid on this contract as prime contractors and are encouraged to make inquiries regarding potential subcontracting opportunities and equipment, material and/or supply needs. All bidders must make positive efforts to use small and minority owned business and women business enterprises.

The Owner reserves the right to reject any or all proposals and to waive technical errors if, in their judgment, the best interests of the Owner will thereby be promoted.
